You offer some accessible works, is it legal?:

We received a notification informing us we didn’t respect the article of economic code XI.245/8 about the lack of restrictions and authorization to distribute adapted works. After analysing it, the article XI.245 must be understood under the context of section number 6 about exceptions of property right, and particularly the definition in article XI.290. It begins as it in French : “Lorsque l’œuvre a été licitement divulguée, l’auteur ne peut interdire”. So exceptions are only what authors can’t prohibit and article XI.245 explains all conditions to distribute adapted works. It can’t be understood as a ban for an original work adapted by the author or by the editor. Articles about the distribution of adapted works to disable people must be understood within the spirit of the law, independently of the redaction of the article, using article XI.190 of economic code.

Moreover, the ban of a disabled person to a website based on his disability is a discrimination based on article 2 of Convention on the Rights of Persons with Disabilities of the UN.

Entities who collect copyright taxes must take into account this analysis.

One of your work is not accessible to a disability, can I use the exception on copyright?:

You can’t adapt a work of Nerv Project ASBL or the kujiu.eu blog based on exception of copyright as mentioned in article XI.190 of Belgian economic code. In facts, nor the author nor the editor can’t oppose to it. But, our works are published under a free license, like CC-BY-SA or EUPL. These licenses permit you to distribute, share, change, use in your own works, and more. Your adaptation must be done within the scope of the license, because using the exception of copyright implies restrictions and ban the redistribution, change and other rights of the license. All restrictions of licenses are lighter than exception of copyright’s framework. Create an adaptation based on the exception can be interpreted as a discrimination based on article 30 of Convention on the Rights of Persons with Disabilities. You’ll ban your public to create works based on our publications, whereas person without disability can.
